Kingwood Receivables Maintenance, Inc., doing business as K.W. Receivables (“K.W. Receivables”, “we”, “our”, or “us”), respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when you visit our website at www.kwreceivables.com and any related services that link to this policy (together, our “Services”), and our practices for using, maintaining, protecting, and disclosing that information.
Because we are a financial company, much of the information we collect through our factoring application is nonpublic personal financial information about the businesses we serve and their owners. We handle that information in accordance with applicable federal financial-privacy law, including the Gramm-Leach-Bliley Act (GLBA), as described in this policy.

In communications, including email, text, chat, and other electronic messages, between you and us.
When you interact with our advertising on third-party websites and services, if that advertising includes links to this policy.
It does not apply to information collected by:
Us through any other means, including on any other website that does not link to this policy; or
Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Services.
Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.
Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 13. Nonetheless, this Policy is still designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) to the extent COPPA applies to the Company. If we learn we have collected or received personal data from a child under 13 years old without verification of parental consent, we will delete that information.
“Personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, date of birth, or Social Security number. The types and categories of personal data we collect or process depend on how you interact with us, and how much of the factoring application you complete. They include:
Contact information. Your name, email address, phone number, and the contents of any message you send us, for example when you use our Contact Us form or call a number listed on the Services.
Business and application information. When you apply for factoring, we collect information about your business, including its legal name, “doing business as” name, organization type, business address, state of registration, phone, email, and Federal Tax ID number.
Business owner information. For each owner listed on the application, we collect the owner’s name, percentage of ownership, home address, phone number, date of birth, and Social Security number.
Financial and credit history. Information about your prior or current factoring relationships, bankruptcy history, past-due taxes, judgments or liens, and pending litigation, and information about your open commercial receivables and their aging.
Receivables and customer account information. Information about the customer accounts you want to factor, including each customer's name, website, average monthly sales, average speed of pay, and the credit line you are requesting.
Identity verification and background-check information. Information we obtain to confirm identity, detect fraud, and evaluate an application, which may include UCC liens, judgments, and public records relating to the business and its owners.
Device and usage information. When you visit the Services, we automatically collect your IP address, browser type and device information, the pages you view, the links you click, the site or ad that referred you, and the dates and times of your visits.
Some of the information identified above, including Social Security numbers, dates of birth, and financial history, is sensitive, and we treat it with added care. We do not use the sensitive information you provide on the factoring application for advertising or marketing. We use it only to evaluate and provide the services you asked for, and for the related fraud-prevention and legal purposes described in this policy. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide certain information, we may not be able to evaluate your application or provide our services.
We also collect:
Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.
If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.
We collect information directly from you when you interact with our Services, for example when you complete our Contact Us form, submit a factoring application, or otherwise communicate with us. Our Contact Us and application forms submit directly to our own server. The sensitive information you provide through the application, such as Social Security numbers and financial history, is received by us and is not shared with our advertising or analytics providers.
As you navigate through and interact with our Services, we use automatic data collection technologies to collect device and usage information, which may include your IP address, browser type and device information, the pages you view, the links you click, the site or ad that referred you, and the dates and times of your visits. We collect this information through cookies and similar technologies, as described below. We use these technologies to understand how visitors use the Services over time and across other websites so that we can measure and improve the Services and our advertising.
The technologies we use for this automatic data collection may include:
Cookies. A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services.
Tags and pixels. Parts of the Services contain small pieces of code, sometimes called tags, pixels, or web beacons, that let us and our providers count and recognize visitors, measure how our pages and advertising perform, and support our advertising.
We use the following third-party tools, which use cookies and similar technologies to collect device and usage information (such as your IP address, pages viewed, and device information) when you visit the Services:
Google. We use Google Tag Manager, Google Analytics, and Google Ads (including conversion measurement and remarketing) to understand how visitors use the Services and to measure and deliver our advertising. Google’s handling of this information is governed by Google’s own privacy policy.
LinkedIn. We use the LinkedIn Insight Tag to measure and support our advertising on LinkedIn. LinkedIn’s handling of this information is governed by LinkedIn’s own privacy policy.
Through these tools, ordinary visit information such as your IP address, the pages you view, and device information is shared with Google and LinkedIn so that we can measure our advertising and reach businesses that may benefit from our services, including through retargeting and similar audiences. As noted above, the information you submit through our Contact Us and application forms, including Social Security numbers and financial information, is not shared with Google or LinkedIn. To the extent this use of automatic collection technologies is considered targeted advertising under applicable law, you may opt out as described in the Your Rights and Choices About Your Information section below. Please note that some features of the Services may be unavailable as a result.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
To evaluate and provide factoring, we may receive information about you and your business from service providers and other sources we use to verify the information you give us and to make underwriting decisions, such as identity-verification, background-check, credit-reporting, and public-records providers. We combine that information with the information we collect directly from you.
We use information that we collect about you or that you provide to us, including any personal data, to:
Respond to your questions, requests, and inquiries.
Review, evaluate, and process factoring applications, including verifying the information you submit and making underwriting decisions.
Provide, service, and manage a factoring relationship once one begins, including billing and collection.
Confirm identity, detect and prevent fraud, protect our rights, and keep the Services and our business secure.
Operate, maintain, and improve the Services, including by analyzing usage and creating aggregated data to understand and enhance how the Services perform.
Measure and understand which of our marketing and advertising efforts are effective, and reach businesses that may benefit from our services, including through advertising delivered on our own and third parties’ services.
Comply with legal, tax, and regulatory obligations that apply to a factoring company, and enforce our agreements.
Fulfill any other purpose for which you provide the information, or for any other purpose with your consent.
We do not use the sensitive information you provide on the factoring application, such as Social Security numbers or financial history, for advertising or marketing. We use it only to evaluate and provide the services you asked for, and for the related fraud-prevention and legal purposes described above.
We do not collect, use, or sell personal data for the purpose of training large language models.
We do not sell your personal data, we do not rent it, and we do not share it with outside companies so that they can market their own products or services to you. We share information only in the limited situations described below, all of which support the services you came to us for.
We may disclose aggregated or de-identified information that does not identify any individual without restriction.
We may disclose the personal data that we collect or that you provide as described in this privacy policy:
To service providers. We use trusted vendors to run our business, including our website host and our analytics and advertising providers (Google and LinkedIn). These vendors are permitted to use the information only to perform work for us, and they are bound by obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them.
For underwriting and verification. To evaluate an application and provide factoring, we may share and verify information with identity-verification, background-check, credit-reporting, and public-records sources. This is inherent to providing factoring and is done to serve your request, not to market to you.
For legal and safety reasons. To comply with any court order, law, or legal process, including to respond to a government or regulatory request; to enforce our agreements, including for billing and collection; and when we believe disclosure is necessary or appropriate to protect the rights, property, or safety of K.W. Receivables, our clients, or others, including for fraud prevention and credit-risk reduction.
In a business transfer. To a buyer or other successor in the event of a merger, acquisition, restructuring, reorganization, dissolution, or other sale or transfer of some or all of K.W. Receivables' assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which personal data held by K.W. Receivables is among the assets transferred. We will take reasonable steps to see that the information stays protected.
With your consent, or to fulfill the purpose for which you provided the information.
The categories of personal data we may disclose in these situations include contact information, business and application information, business owner information, financial and credit history, receivables and customer account information, identity verification and background-check information, and device and usage information.
This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.
Your Privacy Choices — advertising, cookies, and other tracking technologies:
Cookies and other tracking technologies. You can set your browser to refuse all or some browser cookies, or to alert you when these files are being sent. If you disable or refuse cookies, some features of the Services may be inaccessible or not function properly. Some browsers include a Do Not Track (“DNT”) setting. Our Services do not currently detect or respond to DNT signals. Instead, you can use the controls described in this policy.
Interest-based and targeted advertising. To opt out of the use of your information for interest-based or targeted advertising through the tools we use, you can adjust your Google ad settings (at adssettings.google.com) and your LinkedIn advertising settings (in your LinkedIn account under Settings & Privacy). You can also opt out of interest-based advertising from participating companies through the Digital Advertising Alliance’s opt-out page at optout.aboutads.info. Because these controls are cookie-based, you may need to set them again on each browser and device you use, and after clearing cookies.
Global Privacy Control. Some browsers and browser extensions support the Global Privacy Control (“GPC”), which sends a signal indicating your choice to opt out of certain data processing, including “sales” and targeted advertising as defined under some state laws. Our Services do not currently detect or respond to GPC signals. The consumer privacy laws that currently apply to us do not require us to do so, and we do not sell your personal data or use the information you provide on our factoring application for targeted advertising. You can still control cookies through your browser settings and opt out of interest-based advertising using the platform and industry controls described above.
Emails. We do not send marketing emails, texts, or robocalls. If we do send you an email and you would prefer not to receive it, you can ask us to stop at any time using the contact details at the end of this policy.
Much of the information we collect through factoring application is nonpublic personal financial information governed by the Gramm-Leach-Bliley Act (GLBA). Some state privacy laws, including the Texas Data Privacy and Security Act (TDPSA), do not apply to financial institutions or to information subject to that federal law, which limits how those laws apply to us.
To the extent a state privacy law grants you rights in your personal data — such as to access, correct, or delete it, or to opt out of targeted advertising or the sale of personal data — you may exercise them by contacting us at info@kwreceivables.com, through the contact form on our website, or by sending a written request to the address listed at the bottom of this policy.
We do not sell your personal data, and we do not use the information you provide on our factoring application for targeted advertising. We will respond as required by applicable law.
This policy is intended to cover collection of information on our Services from residents of Texas, United States. The laws in other countries may or may not be as comprehensive as those in Texas and the United States. If you are a resident of another state or country and/or are using our Service from outside of Texas, you acknowledge and agree that your information may be transferred to, stored, and processed in the United States where our servers may be located and our central database may be operated. You also acknowledge that your use of our Services shall be governed exclusively by the laws of Texas and as if all transactions take place within Texas. By using our Service, you acknowledge and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy. If you are unwilling to accept these terms, then you agree that you will not use or access our Services.
We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure, with added care for sensitive items such as Social Security numbers, dates of birth, and financial records. Access to the information collected through our factoring application is limited to personnel who need it to evaluate and service factoring relationships. Our Services are served over an encrypted connection, and our application form is designed for the secure submission of sensitive information. Consistent with the safeguards requirements applicable to financial institutions, we maintain security practices and procedures intended to protect the confidentiality and security of this information.
However, no website, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure. Please do not send sensitive information, such as a Social Security number or account numbers, through the Contact Us form or ordinary email; use our secure application form for information of that nature. Any transmission of personal data is at your own risk. If you believe your interaction with us is no longer secure, please contact us right away using the details below.
We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described, and after that for as long as we are required to keep it under applicable tax, financial, and legal recordkeeping rules. Because factoring is a regulated financial activity, some records are held for extended periods even after a relationship ends. When we no longer need information and are no longer required to keep it, we take reasonable steps to delete, destroy, or de-identify it.
We may update this policy from time to time as our practices, technology, or the law change, and we will provide notice of any such changes as required by law. The effective date is identified at the top of this policy. We will notify you of changes by updating the effective date and posting the revised policy on the Services, and if the changes are significant we will make a reasonable effort to flag them. Please check the Services periodically to see the current policy.
The adoption or publication of this policy does not subject us to any stricter duty in its collection, handling, storage and disclosure of nonpublic information than otherwise applies to us under applicable law.
